OUR BOOKING TERMS AND CONDITIONS

 

This document sets out the standard booking condition ("Conditions") of our company TAKEOVER EVENTS LTD – Company Number: 13358801 registered in Manchester, United Kingdom. These terms and conditions apply to all reservations with us, including those made through the website us (takeoverevents.co.uk) and by making a reservation, you accept and understand these terms and conditions, which will be included in your contract.

 

Be sure to read this entire document before booking. The sections with important and essential content are underlined. 

 

I.DEFINITIONS  

The words "we", "us" and "our", "ours" and so on mean our company, while references to "you" "your", "yours”, mean all Guest / all Guests. 

 

“Guests(s)” refers to all paying customers and, in the context of a Group, a Guest is an individual person who is part of a relevant Group, with “Group” referring to a group of Guests booking together. 

 

“Booker” refers to a Guest who acts on behalf of other Guests in a Group by handling payment for the holiday and other logistics. 

 

II. CONTRACT  

 

To sign a contract with us you must book, with the price included, at least two or more of the following pre-agreed combinations of services:

a) transport (e.g. coach transfer from the airport to the resort);

b) accommodation (e.g. in one of our partner apartments); and,

c) other tourist services not ancillary to transport or accommodation which account for a significant part of the arrangements (e.g. an event pass);

     when the above services are taken together and:

d) cover an uninterrupted period of at least 24 hours; and/or,

e) include an overnight stay. 

 

   

If you wish to confirm your holiday booking, you guarantee that you accept and have the right to accept on behalf of your country and / or group to obtain permission to accept from your group, these Terms, which you confirm that you have read, accepted, and understood completely. These Terms and Conditions, together with the information contained in your booking confirmation email ("Invoice"), contain your contract with us (subject to point 4) and the consent of all listed on the holiday booking on whose behalf Booker acts. All changes to these terms and conditions are confirmed in writing by us, and we have the right to make changes to the terms and conditions that will affect our website. We recommend that you check our website for updated Terms before booking.

 

In the event that you confirm your holiday booking, you also agree to process the personal information you provide regarding you and your group without additional conditions. Our holidays begin and end at the destination or travel points listed on your invoice. We are not responsible for your travel to and from the destination or points of travel or for any costs, including, but not limited to, travel costs, accommodation costs, maintenance or loss of income caused by delays (regardless of the reason). We are not responsible for the operation or non-operation of your flights to and from the destination or points of travel, regardless of the reasons for this, including flight cancellation, delay, rerouting, etc. We are not responsible and are not included in the price of the service and the contract the value of airline tickets and airport taxes, which are at your expense. 


 

We are also not responsible for providing health and / or travel insurance to cover the relevant risks during your stay. The above is your commitment and is entirely at your expense, and the value of insurance is not included in the price of our service and contract you accept responsibility to make your own insurance arrangements before arriving on your holiday. We are not responsible for any possible incidents and accidental events during your stay that are not our fault. We are not responsible for the condition of your chosen hotel and the condition and operation of the facilities next to and in it, including spa area, swimming pools, cleanliness, hygiene, hotel maintenance, ski slopes, ski lift, etc. We are not responsible for all possible restrictions and cancellations of events and happenings due to COVID 19. However, these possible costs can be reimbursed according to any private insurance policy you have and which you should provide at your expense.

 

All prices of telephones and websites, offers and information for reservations are subject to our written confirmation due to their possible development by the service provider. That's why it's important to check your verification invoice as soon as you receive it.

 

We will not accept any liability for any errors on your Invoice that are not brought to our attention in writing at ……………………………….within five clear working days of the date of your Invoice.

 

You must be at least 18 years of age to book with us on our website. There may be other age restrictions relating to our offers or services and these will be detailed in these offers or in the descriptions of these services. 

  

III. PAYING FOR YOUR HOLIDAY

 

The holiday booking procedure is as follows: 

          a) on making a booking you should provide us with the number of places you wish to reserve by completing the online 

           booking form on our website with the Guest(s) names together with any additional Guest(s) information (if required);

           b) your Invoice will be sent to the Booker via email; 

           c) your Invoice will state the total holiday booking cost and the dates by when payments must be received by us;

           d) in the event that the final payment is not received by the due date, then we may automatically treat this contract as

               cancelled and terminated; 

           e) In the event of an incorrect invoice payment, you will be responsible for contacting us and highlighting the error within

               five business days of the invoice date.

           f) the price of our service does not include the provision of ski equipment and ski passes for slopes and lifts, as the previous

               one is at the expense of the Guests. In case you decide to engage us with the provision and reservation of the specified

               equipment and cards, you should notify us in advance, in which case you will enjoy a discount on the price of equipment

               and ski passes. The discount will be different depending on the hotel you choose. Once you have booked your equipment,

              lessons and lift passes, no refunds or cancellations will be accepted. Please note that we cannot refund part of the pre-

              booked service if you do not use all or part of the booked service. In all cases, we are not responsible for lost, stolen or

              missing ski equipment

 

IV. CHANGES IN THE PRICE

 

Price of your holiday shall remain the same from the time that it was booked subject only to the correction of obvious pricing errors and where expressly stated in these Terms. We reserve the right to correct any errors in both advertised and confirmed prices. We also reserve the right to amend prices with regard to changes in any external supplier costs (subject only to new bookings or items on current bookings that have not yet been paid for). 

 

If there is an error in room type, occupancy, or price, we reserve the right to amend the price or accommodation to a reasonable alternative should that room type not be available.

 

Due to the constant change in oil and fuel prices, the price you pay for this component of your holiday booking may not be displayed on our website, as we may not always be able to make changes as quickly as oil prices change.

 

Once the price of your chosen holiday has been confirmed, then, we will only increase the price of your holiday in the following circumstances: a) changes in transportation costs (including the cost of fuel); and, b) dues, taxes or fees chargeable for services; and, the fluctuation of exchange rates also means that the price of your travel arrangements may change after you have booked your chosen holiday. 

 

You will not be charged for any increase equivalent to ......% or less of the price of your booking, which excludes insurance premiums and any amendment charges. You will be charged for any amount in excess of ........% of the holiday booking price. If this means that you have to pay an increase of more than 10% of the price of your original holiday booking, you will have the option of:   

          a) accepting a change to another holiday if we are able to offer one (if this is of equivalent or higher quality you will not have

              to pay more but if it is of lower quality you will be refunded the difference in price); or,

         b) cancelling and receiving a full refund of all monies paid except for any amendment charges initiated.

  

V. DEPOSIT

 

You may be required to pay a deposit to the on-site accommodation provider upon arrival at the destination. Information about the deposit can be found on our website or in your invoice. This deposit will be withheld during your holiday to compensate for any fees, fines or other amounts incurred by you or your group during your holiday. The deposit will be refunded after you leave the accommodation and provided that no damage and / or absences are caused by you or your group. 

  

VI. TRAVEL AFTER ARRIVAL

 

All guests on board the airport bus transfer to the resort with the acceptance of these conditions expressly declare and undertake to comply with and not to violate the rules of travel. It is forbidden to use cigarettes, alcohol and / or other narcotics and prohibited substances during transport. Failure to comply with the relevant legislation will be treated as a breach of contract by the respective Guest, and may lead to criminal liability of the respective guest. This may lead to the termination of the holiday contract and / or eviction of the Guest (s) from the vehicle.

 

Airport bus transfers are offered as a stand-alone option and are directly related to the published flight hours. In this regard, we do not accept any responsibility for cancelled, delayed, rescheduled flight hours, or diverted flights purchased from a third party that affect the booked transfer of the airport bus. If the booked flight is cancelled, delayed, scheduled, or rescheduled by the relevant airline, we cannot change the published airport bus transfer schedules to accommodate these changes, as airport bus transfers provide transportation for multiple inbound and outbound flights. flights.

 

Should your flight be cancelled, delayed, re-scheduled or re-routed by the relevant airline after an airport coach transfer has been booked, it is the responsibility of the Guest(s) to inform us. 

 

When travelling by coach from the airport to the resort you must be at your pick-up point at the departure time, final details of which including the location of the pick- up point, will accompany your travel documents.

 

In the event that the relevant airport coach transfer is cancelled by us, the Guests will be offered a full refund of the airport coach transfer cost only thereby allowing Guests to use this refund towards making their own travel arrangements to and from the destination. 

 

The guests agree that due to meteorological conditions, mechanical damage, traffic, accident, or other reason other force majeure circumstances there is a possibility for delay and / or non-realization of the respective transport to the resort. In this regard, we cannot be held responsible for any inconvenience or costs you may incur as a result of such delays.

 

VII. YOUR LUGGAGE

 

Luggage will be stored in the hold of the coach and is not accessible during the airport transfer journey. 

 

It is the responsibility of each individual Guest to ensure the safe loading under instruction of the driver and unloading of their luggage on any coach. We are not responsible for any luggage that was incorrectly loaded and subsequently damaged, or that was lost due to being left behind at the pick-up point. 

 

Small hand luggage may be taken on board the coach to carry toiletries, passports, money, and other valuables. We are not responsible for any items left on board the coach or for money and valuable items stored in the hold. 

  

VIII. CHANGING OR CANCELLING YOUR BOOKING

 

Subject to clauses of these Terms:

 

Cancellations must be confirmed in writing by the Booker. Your cancellation will not be confirmed until you have received confirmation in writing from us. To cover the cost of processing your cancellation and compensate us for the risk that we may not be able to re-sell your holiday, we shall only refund you as follows – for cancellation requests received and confirmed:

 

           (i) prior to 21 August 2021, you shall be refunded 90% of any sums you have paid (net of any credits or discounts applied),

              minus a 5% admin & processing fee. 

           (ii) prior to 29 September 2021, where you have paid for your booking in full, you shall be refunded any amount over 70%

                of the total booking value (net of any credits or discounts applied), minus a 5% admin & processing fee.

           (iii) prior to 29 November 2021, where you have paid for your booking in full, you shall be refunded any amount over 40%

                 of the total booking value (net of any credits or discounts applied), minus a 5% admin & processing fee.

           (iv) between 30 November 2021 and more than 45 days prior to start of the event (check your booking for the event start

                 date), where you have paid for your booking in full, you shall be refunded any amount over 30% of total booking value

                 (net of any credits or discounts applied), minus a 5% admin & processing fee.

          (v) No refunds whatsoever can be made for cancellations 45 days prior to event start date (check your booking for the

                 event start date).

 

Refunds shall be made back to the payment card used for the original payment within 45 days after the cancellation has been confirmed.

 

If you change your booking: 

 

After you notify Guest names to us and after your Invoice has been issued by us, where you request a change of name of an individual in your Group and if we are able to comply with your request this will incur an administrative charge payable by you (if done before 28 days of the trip) . We reserve the right to treat your holiday booking as cancelled and to subject it to cancellation fees in the event that you request a change of name of an individual in your group within eight weeks prior to departure.

 

You may add additional Guests to your Group at any time provided that: 

 

- We have confirmed availability;   

- you have made the necessary payments to us in respect of the additional Guests. 

 

Tickets cannot be replaced if lost, stolen or destroyed, purchase from or resale from unauthorized sellers will invalidate the ticket.​

 

We reserve the right to treat your holiday booking as cancelled and render it subject to cancellation charges in the event you sell, attempt to sell, or otherwise transfer any Package Component to a third party without our prior written consent. 

 

If we change your booking: 

 

By making a reservation, you acknowledge and understand that some aspects of the package components may change from the usual and / or expected rate and therefore we reserve the right to make changes and correct any errors or changes in the package components at any time before and after your holiday booking is confirmed. We can make two types of changes:

 

          (i) minor changes, such as changes in airport bus transfer times of less than twelve hours and changes to accommodation to                another of the same or higher standard, which may not be notified specifically to you and which are not give you the right

              to cancel your holiday reservation without penalty; and,

 

         (ii) In the event that major changes need to be made and if a major change has been made to your holiday booking in respect

               of which you received your invoice and / or if we cancel your holiday booking within 60 days from the date of departure,

              you can choose:

 

-accept the changed arrangements as notified to you by us;

-purchase a replacement holiday from us of at least the same standard if available (and pay more or receive a refund in respect of any price difference); or,

-cancel your holiday and receive a full refund in respect of all monies paid to us.

 

We shall not be liable in any circumstances whatsoever in respect of any costs or expenses that you incur in relation to any Package Components booked through a third party, including but not limited to airfare and travel insurance. 

  

If we cancel your booking: 

 

In the event that we fail to provide a minimum number of reservations for a particular accommodation, we have the right to cancel and cancel your holiday. We reserve the right to cancel all or part of each component (s) of the package for the reasons described in this section. 

 

We reserve the right to cancel your holiday in any circumstances, but where your holiday is cancelled by us for any reason other than one mentioned in these Terms, we will offer you the choice of either purchasing an alternative holiday of at least the same standard if available (and paying or receiving a refund in respect of any price difference) or receiving a full and immediate refund of all monies paid to us.

 

We cannot under any circumstances whatsoever meet any expenses or costs you incur as a result of any cancellation. 

 

Very rarely we may be forced to cancel, shorten or change your holiday after the date of departure, when there are circumstances forming force majeure. In these very rare situations, we cannot refund any refunds, or pay any compensation, or be responsible for any costs or expenses you may incur as a result. "Force majeure" means any event which we or the relevant supplier of the package component in question could not, even with all due care, anticipate or avoid. Without prejudice to the generalities of the above-mentioned force majeure events, they may include, but are not limited to, war or threat of war, riots, civil strife, terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather conditions, fire and other similar events. reasonable control

 

IX. YOUR CONDUCT AFTER ARRIVAL

 

In connection with the normal course of the holiday, the guests declare that: 

 

all local laws, including but not limited to those relating to the consumption of alcohol and illegal drugs and other prohibited substances, are at all times obeyed; 

 

no Guest smokes in the hotel accommodation or apartment, or on board any public or private transport, or in any way causes a fire hazard or contravenes the local antismoking laws; and, 

 

Guests act in a responsible fashion and do not behave in a way likely to cause damage to property, or offence or danger to other people. 


 

The Guests agrees to be responsible for any damage to the accommodation or loss to the accommodation owner or manager or other supplier, which must be paid at the time direct to the relevant accommodation owner or manager or other supplier. All damages and / or absences are at your expense.

 

If the behaviour of any Guest is causing or is likely to cause offence, danger, damage to property and/or distress to others, we reserve the right at all times and without prior notice to terminate the holiday of the Guest(s) concerned or, at our absolute discretion, that of the whole Group. If a Guest’s holiday is terminated or if a Guest is expelled from the booking or Package Component we will have no further responsibility to refund that Guest nor to compensate that Guest in respect of return travel costs. No refunds or payments will be made under any circumstances whatsoever and we will not pay any expenses or costs incurred as a result of holiday termination or expulsion from the booking or Package Component .

 

X. ACCOMMODATION

 

Only those Guests named on your Invoice can use the Package Components arranged by us under your holiday booking. You are not permitted to share any particular Package Component with any person not named on your Invoice. 

 

XI. DEALING WITH PROBLEMS AND COMPLAINTS

 

If a complaint arises, you must report it as soon as possible to our representative, in addition to the relevant supplier of the packaging component, so that efforts can be made to rectify the situation to your reasonable satisfaction and within a reasonable time.

 

XII. INSURANCE  

 

All Guests must travel with travel insurance and / or holiday insurance for winter sports and health insurance, under which they are fully covered before departure. We are not responsible for guests traveling without proper insurance. The provision of insurance is entirely a commitment and at the expense of the Guests. In this regard, by accepting these terms and conditions, you guarantee and declare that you will not have any claims for property and non-property damages against us as a result of events and damages due to lack of insurance.

 

XIII. PASSPORT

 

It is your responsibility to ensure that you have a valid passport and to ensure that you have any relevant visas that may be required. We are not responsible for the validity of your documents.

 

XIV. OUR RESPONSIBILITY FOR YOUR HOLIDAY

 

We will do everything necessary to ensure that the services and components of the package that make up your holiday are provided by reputable and proven suppliers.

 

XV. FORCE MAJEURE

 

The risk of skiing being adversely affected by weather conditions has to be accepted. Where transport is arranged to other resorts the costs will be paid locally by the relevant client. We will not be liable for any loss, delay or costs connected with or arising out of adverse weather conditions, including but not limited to blocked and closed roads and airline delays. If, as a result of Force Majeure, you miss your return departure and further accommodation is required, we will not be responsible for this cost.

 

If, due to adverse weather conditions or other force majeure circumstances, pre-booked ski kits, facilities, excursions or tours are not available, we will not be liable in this regard as the lack or inability to use these kits, facilities, excursions or tours are placed beyond our control. We will not refund unused parts of the holiday, such as travel, transfers, car rental, empty accommodation and unused ski equiptment. 

  

XVI. WHAT TO EXPECT FROM OUR SERVICES

 

All accommodation is as per description on our website at the time of booking but this does not affect our right to amend any errors in pricing or description.

 

Check-in is usually between 1200 and 1300, and check out of rooms is usually between 1100 and 1200 irrespective of your time of departure. Not all accommodation will have 24-hour check-in facilities however some hotels and apartments are able to provide facilities interim storage of luggage. In most apartments a blanket, bed linen and pillows are provided for each bed, but if you need specific information, please ask us at the time of booking or ask the reception of the hotel or apartment during check-in. Most apartments, are compact and the prices listed are for the maximum number of beds, including two people who share a double bed. 

 

In some accommodation it may be necessary to charge extra for the use of swimming pools and spa area. When we have been informed, this is stated in the description at the time of booking. It is important to know that we will not cover the costs you incur for additional facilities and if you need specific information, please ask us at the time of booking or ask the reception of the hotel or apartment during check-in, including the use of swimming pools and spa area.

  

Hotels may lock their main doors at a specified time. If you require specific information, please check with the hotel what time this is especially if your arrival is likely to be late or if you are delayed en route. Upon arrival at your apartment, please check the inventory to make sure the furniture is in good condition. Anything that is missing or broken must be reported to reception immediately or you may be charged. Please leave your hotel or apartment as clean as you found it.

   

XVII. OUR EVENT

 

Conditions in ski resorts can change unexpectedly. In this regard we reserve the right to change or alter the advertised programme and line up of all activities without prior notification or liability to refund in whole or in part. 

 

XVIII. DATA PROTECTION

 

We are committed to protecting your privacy. We may disclose your details such as names, address, contact details upon request from competent authorities, including public authorities such as customs and / or immigration, if required or required by law.

 

XIX. USING OUR WEBSITE

 

By accepting these terms and conditions, you expressly state and agree not to make direct links to our website for any purpose. The content and software of our website are our property.
